General Terms and Conditions (GTC) of Fablago UG (haftungsbeschränkt)
1. Scope of Application
1.1 These General Terms and Conditions (GTC) apply to all orders placed via the webshop Fablago.com, operated by Fablago UG (haftungsbeschränkt). The shop is aimed at both consumers and businesses.
1.2 For businesses, statutory provisions apply unless otherwise agreed in these GTC.
1.3 Deviating terms and conditions of the customer are not recognized unless Fablago UG (haftungsbeschränkt) expressly agrees to their validity in writing.

3. Offer and Conclusion of Contract
3.1 The presentation of products in the online shop does not constitute a legally binding offer, but an invitation for the customer to submit a contractual offer.
3.2 By clicking the button “Buy Now”, the customer submits a binding offer to purchase the goods in the shopping cart, individually for each item.
3.3 The contract for each individual item is concluded only upon dispatch of the goods. This is usually indicated to the customer by a shipping confirmation via email. Should the shipping confirmation not be sent in individual cases, the contract is nevertheless considered concluded upon dispatch of the goods.
3.4 Partial deliveries are permissible, insofar as they are reasonable for the customer, even without prior consultation with the customer. If items cannot be delivered to us for reasons beyond our control, no purchase contract will be concluded for these products. The purchase price for the undelivered products will be refunded immediately. No further claims by the customer exist.
3.5 Benefits such as free shipping above a certain order quantity are not lost due to a partial delivery.
4. Prices and Payment Terms
4.1 All stated prices are final prices and include the legally applicable value-added tax.
4.2 In addition to the prices, shipping costs will be incurred, which are shown during the order process.
4.3 Payment is made via the payment methods offered during the order process, including PayPal and credit card.
4.4 There is no minimum order value per order.
5. Delivery
5.1 Delivery is made to all member states of the European Union, including Germany.
5.2 Shipping is carried out via DHL, unless otherwise offered during the order process. Express shipping is offered if selectable during the order process.
5.3 The delivery time is generally 3–14 business days, unless otherwise stated in the product offer.
5.4 Orders are usually processed, prepared for shipment, and dispatched by us within 2 business days.
5.5 Shipping costs are calculated as a flat rate of €15 per order for international shipping within the EU. Shipping is free within the EU for orders with a value of €150 or more per order.
6. Right of Withdrawal
6.1 Consumers have a statutory right of withdrawal of 14 days from receipt of the goods.
6.2 The right of withdrawal does not apply to:
- Food, consumables, and pet food that are not suitable for return for reasons of health or hygiene protection, especially if their seal has been removed after delivery,
- Goods that can spoil quickly or whose expiry date would be quickly exceeded,
- Goods manufactured according to customer specifications or clearly personalized.
6.3 To exercise the right of withdrawal, the customer must inform Fablago UG (haftungsbeschränkt) by means of a clear declaration (e.g., by email or letter).
6.4 The customer bears the costs of the return shipment.
6.5 The goods must be returned immediately and no later than within 14 days after submitting the declaration of withdrawal.
6.6 If you withdraw individual items from an order and the total value of the retained goods falls below the threshold for free shipping, we reserve the right to subsequently charge the regular shipping costs.
This does not apply to returns due to statutory warranty rights.
7. Warranty
7.1 For consumers, the statutory warranty rights according to German and European law apply.
7.2 For businesses, the warranty period is one year from delivery.
7.3 No warranty beyond the statutory warranty rights is granted.
8. Liability
8.1 Fablago UG (haftungsbeschränkt) is liable without limitation for intent and gross negligence.
8.2 In cases of slight negligence, Fablago UG (haftungsbeschränkt) is only liable for the breach of essential contractual obligations (so-called cardinal obligations). In these cases, liability is limited to the foreseeable, typically occurring damage.
8.3 Liability for damages resulting from injury to life, body, or health, as well as under the Product Liability Act, remains unaffected.
9. Data Protection
9.1 The collection and processing of personal data are carried out in accordance with the Privacy Policy available on the website.
9.2 Data is processed exclusively within the legally permissible framework and is not passed on to unauthorized third parties.
10. Final Provisions
10.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
10.2 For consumers within the European Union, the legally stipulated place of jurisdiction applies.
10.3 For businesses, the place of jurisdiction is Berlin.
10.4 Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.

Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us:

by means of a clear declaration (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but this is not mandatory.
To meet the deadline, it is sufficient for you to send your notification of exercising the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
For this reimbursement, we will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no case will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back.
You shall send back or hand over the goods to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
If you withdraw only part of the ordered goods and the conditions for a granted shipping cost advantage (e.g., free shipping above a minimum order value) subsequently cease to apply, we reserve the right to recalculate the regular shipping costs.
You bear the direct costs of returning the goods.
You only have to pay for any diminished value of the goods if this diminished value is due to handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
- Food, consumables, and pet food that are not suitable for return for reasons of health or hygiene protection, especially if their seal has been removed after delivery or they have been opened,
- Goods that can spoil quickly or whose expiry date would be quickly exceeded,
- Goods manufactured according to customer specifications or clearly personalized.
